The Responsible Person requirement

EU Cosmetics Regulation 1223/2009 requires every cosmetic product sold in the EU to have a Responsible Person (RP) — an EU-established company or individual who takes legal responsibility for compliance. If your distributor acts as your RP, they become legally responsible for ensuring your product meets safety, labelling, and notification requirements. This gives them significant leverage and means they must fully understand your formulations.

Alternative: appoint a specialist RP service (regulatory consultancy) to handle compliance, with a separate distribution partner for commercial operations.

CPNP notification before sale

Before placing any cosmetic product on the EU market, it must be notified to the Cosmetic Products Notification Portal (CPNP). Notification includes: product name, category, country of first placing on market, RP details, frame formulation, nanomaterials declaration, and CMR substance declarations. CPNP notification is required per product and per market language (for label review). Your RP or distributor handles this.

Safety assessment: the key document

Every EU cosmetic product must have a safety assessment conducted by a qualified cosmetic safety assessor (typically holding a PhD in toxicology, pharmacy, medicine, or a related field). The safety report is part of the Product Information File (PIF) and must be available to authorities on request. Expect to pay €500–€3,000 per product for a safety assessment, depending on formulation complexity.
