Colour Cosmetics in Chile: ISP Compliance & Market Entry

Chile's colour cosmetics market is sophisticated and heavily influenced by K-beauty, international luxury brands, and social media trends. The ISP regulates cosmetics under D.S. 239/2002 with standards closely aligned to the EU — including an animal testing ban enacted in 2013. Chile's FTA network provides duty-free access for many EU and US makeup brands.

ISP registration for colour cosmetics

Standard colour cosmetics (lipstick, foundation, eyeshadow, mascara, blush) are generally classified as low-risk cosmetics and require ISP notification rather than full registration. Higher-risk products (permanent hair dyes, bleaching products, products with strong active ingredients) may require full ISP Registro Sanitario. A Chilean representante legal is mandatory — direct import without a Chilean legal representative is not permitted. ISP notifications are processed faster than registrations but can take 2–6 months depending on workload. Products may not be sold before notification or registration is confirmed, unlike Colombia's pre-market notification system.

Animal testing ban and EU alignment

Chile enacted a ban on animal testing for cosmetics in 2013 — one of the first LATAM countries to do so. This aligns Chile with EU and UK standards, meaning: (1) Products tested on animals anywhere in the supply chain cannot claim compliance with Chilean cosmetic law. (2) EU-cruelty-free certified products are well-positioned for the Chilean market. (3) CI colorants must appear on the label alongside INCI names — Chile follows EU Annex IV colorant standards. (4) EU-banned colorants and hair dye actives are also prohibited in Chile under D.S. 239/2002. (5) Hair dye products with PPD must carry allergy warning language in Spanish.

Import duty advantages for colour cosmetics

Chile's FTA network provides significant duty advantages for international cosmetics brands: (1) Chile–EU FTA: 0% duty for most EU-origin cosmetics, including colour cosmetics. (2) Chile–US FTA: 0% duty for most US-origin cosmetics. (3) Korea–Chile FTA: preferential rates for Korean cosmetics (K-beauty is the fastest-growing import category in Chilean cosmetics). (4) For other origins, Chile's MFN tariff is typically 6% for cosmetics. (5) Chilean IVA (VAT) is 19% and applies to all cosmetics — domestic and imported — and is reclaimed by the importer with a Chilean RUT registration.
